2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 30(a), 32(3), 36 and 33 of the Bihar Prohibition and Excise (Amendment) Act, 2018 registered in connection with Begusarai Excise P.S.Case No. 191 of 2024.
3. The petitioner is named in the FIR. It is alleged that the petitioner along with other accused persons were illegally extracting spirit by cutting the tanker. It is further alleged that total 5630 of illegal spirit was recovered from the possession of the accused persons, including the petitioner.
4. The learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.46869 of 2024(2) dt.11-07-2024 2/2 that he has falsely been implicated on the basis of suspicion and he is in custody for the alleged recovery of spirit since 09.05.2024.
5. Considering the above facts and circumstances, let the petitioner, above-named, be released on bail upon completion of six months in custody on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 2, Begusarai in connection with Begusarai Excise P.S.Case No. 191 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
