JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 29-01-2016 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioners apprehend their arrest in Pipra P.S. Case No. 16/2015, registered for the offences punishable under Section 147, 148, 149, 448, 323, 324, 307 and 302 of the Indian Penal Code.
The allegation is that ten accused persons including three women petitioners came to the house of the informant and assaulted the father of the informant as a result of which he received grievous injuries on his head and other parts of the body and when informant and other family members came to rescue
Patna High Court Cr.Misc. No.51621 of 2015 (3) dt.29-01-2016 2/2 they were also assaulted by them. All the accused persons have actively participated in the offence.
Learned counsel for the petitioner submits that the petitioners have committed no offence and have falsely been implicated in this case. There is no specific allegation of assault against these petitioners.
Considering the facts aforesaid and the nature of allegation and that the petitioners above named are women, the petitioners above-named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 5,000/- (five thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Masaurhi, Patna in connection with Pipra P.S. Case No. 16/15, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
