2. The present writ petition has been filed for the following relief/s:- I. For making actual payment under the MACP (Modified Assured Career Progression) which is financial up gradation and the same has been granted with effect from 17.12.2023 by the Government which is contained in Memo no.9238 dated 25.07.2024.

II. For making payment annual increment with effect from July, 2024.

III. For making payment Urban Transport

IV. For grant of Uniform Allowance for the financial year 2024-25.

V. For any other relief/reliefs for which the petitioner may be found entitled."

Learned counsel for the petitioner submits that at the level of the Government, the Transport Department, Government of Bihar has already issued a letter in favour of the petitioner which is contained in Memo No.9238 dated 25.07.2024 in addition to other relief which the petitioner has demanded in the present writ petition. Counsel further submits that for the fulfillment of his grievances, he has filed representation before the District Transport Office, Samastipur which is annexed as Annexure-P/6. But on his representation, no decision has been taken.

4. Learned counsel for the State submits that a time may be fixed so that the decision may be taken with regard to the petitioner's representation.

5. In the light of the submissions made, it is hereby directed to the petitioner to file a fresh representation before the District Transport Officer, Samastipur (Respondent no.4) within 30 days from today along with a copy of this order claiming all

Patna High Court CWJC No.10147 of 2025(2) dt.03-07-2025 3/3 the relief which he has demanded vide Annexures-P/6 and P/7. Respondent no.4 is directed to grant all admitted dues of the petitioner for which he is legally entitled within 90 days from the date of receiving the petitioner's fresh representation.

6. It is made clear that if, petitioner is not entitled for any other relief, then in that case, the Respondent no.4 shall pass a reasoned and speaking order on his representation.

7. Accordingly, with the aforesaid direction, this writ petition is hereby disposed off.
