JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 24-08-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Dumariyaghat P.S. Case No. 126 of 2015 registered under Sections 147, 148, 149, 341, 323, 307, 302, 325, 504 and 506 of the Indian Penal Code, Chief Judicial Magistrate, East Champaran, Motihari.

The accusation is that, on 29.11.20145, at 10 A.M., nine persons named in the F.I.R. was causing assault to Jaggu Sahni, so of informant, in front of the house of Raju Mian, when Balkisun Mahto, husband of informant made protest then he was assaulted though fists and slaps, on which, he fell down. At that time, accused persons jumped on the chest of her husband.

Patna High Court Cr.Misc. No.33250 of 2016 (2) dt.24-08-2016 Thereafter, informant took her husband to the hospital but in course of treatment, he died.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
