Petitioner seeks regular bail in connection with Araria PS Case No. 620 of 2021 registered under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

Police intercepted a truck and recovered 1052.460 liters of illicit liquor and arrested the petitioner from the said truck.

Learned counsel for the petitioner submits that petitioner has got no criminal antecedent and the driver of the truck succeeded in fleeing away. The petitioner had taken lift from the truck in order to reach his destination. The petitioner was not aware about the illicit liquor being kept therein. He is in custody since 23-07-2021 and petitioner is neither owner of the truck nor its driver.

No.51628 of 2021(2) dt.15-04-2022 2/2 Regard being had to the submissions made by the parties, taking into consideration the materials available on record, the fact that petitioner is neither the owner nor the driver of the truck in question, he is in custody since 23/07/2021 having no criminal antecedent, as such, I am inclined to grant regular bail to the petitioner.

Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge cum Special Judge (Excise Act), Araria in connection with Araria PS Case No. 620 of 2021.
