Petitioner is languishing in judicial custody since 26.05.2017 in connection with Banka P.S. Case No. 281 of 2017 for offences punishable under Sections 419, 420 and 406 of the Indian Penal Code.
The prosecution case, as lodged by the informant, is that she got Ujwalla Gas connection and after two days petitioner came to her house and represented himself as a staff of HP Gas Agency and stated that her gas suffered from some fault and took away the cylinder to replace it by a good cylinder but did not return. It is alleged that while petitioner was doing same type of offence with other co-villagers, he was caught red handed and was
Patna High Court Cr.Misc. No.35522 of 2017 (2) dt.18-08-2017 2/2 handed over to the police.
It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal antecedent. It has further submitted that due to political rivalry, he has been falsely implicated in the aforesaid case However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail after completion of six months in custody on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Banka P.S. Case No. 281 of 2017.
