The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323 & 364/34 of the Indian Penal Code.

This is the second attempt of the petitioner for grant of bail. Earlier, vide detailed order dated 18.08.2021 passed in Cr. Misc. No.24276 of 2021, the prayer for bail of the petitioner was rejected by this Court on account of suppression of facts.

It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He is quite innocent and has been falsely implicated in this case. No incriminating article has been recovered from his conscious

Patna High Court CR. MISC. No.51900 of 2021(3) dt.03-11-2021 2/2 physical possession. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. Charge-sheet has been submitted in this case. The mobile phone through which the demand for ransom was made is not belonged to the petitioner. The petitioner has been languishing in custody since 04.10.2020.

Learned APP for the State opposed the bail petition.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Mokama P.S.
