This application has been filed for quashing of order dated 03.08.1999 passed by learned Judicial Magistrate Bettiah in Complaint Case No. 1680 C of 1998 dated 11.12.98 , whereby and whereunder cognizance of the offences U/s 420, 406 and 34 of IPC was taken against the petitioners and others . 3 . At the outset, learned counsel for the State appears and submits that as per report submitted by the Superintendent of Police, Bettiah, it appears that the complainant in this case had already died.

4. In the light of the aforesaid facts and circumstances

Patna High Court CR. MISC. No.43449 of 2023(6) dt.08-04-2024 2/2 of the case , this application is disposed of with a direction to the petitioner to file appropriate application before the Court concerned and the same shall be disposed of by the learned Court below in accordance with law preferably within a period of six months from the date of copy/production of this order. 5 . Accordingly , this application is disposed of with the aforesaid directions.
