JUSTICE ASHUTOSH KUMAR ORAL JUDGMENT Date : 03-02-2022 Heard Mr. Suresh Kumar Ishwar, learned Advocate for the petitioner and Mr. S.K. Ranjan for the State. The petitioner, who is the In-charge Headmaster of Yasomati Sanskrit Prathmik Sah Madhyamik Vidyalaya Belawarish, Ghoh in the district of Aurangabad has approached this Court for direction to respondents for making payment of salary which has been stopped since 01.01.2020 without any reason.

The learned counsel for the petitioner has submitted that despite the petitioner having represented

Patna High Court CWJC No.1901 of 2021 dt.03-02-2022 2/2 before the authorities, his grievance has not been redressed. The petitioner does not know of any reason which could authorize non-payment of salary to the petitioner for all this while.

Considering the afore-noted submission on behalf of the petitioner, this Court directs that in the event of a representation being filed before the respondent no. 7 within a period of two weeks, the concerned respondent shall look into the matter and shall pass a reasoned order intimating why the salary had been stopped for all this while and if there is no justifiable reason for stopping the salary, he shall ensure payment of salary and the arrears which have accrued up till now to the petitioner forthwith without any delay. Such order ought to be passed within a period of six weeks of the receipt of such representation. Any failure of the concerned respondent in dealing with this matter within the time frame shall be viewed adversely and the Court will consider passing necessary orders against respondent no. 7.

With the aforesaid direction/observation, the writ petition is disposed of.
