The petitioner apprehends his arrest in a case registered for offences punishable under Sections 363, 366 (A)/34 of the Indian Penal Code.

It is contended on behalf of the petitioner that there was a love affair between the petitioner and the victim girl which was known to everybody and they had willing married and had gone to Himachal Pradhesh. In support of such contention, affidavits of the girl and the petitioner have been appended as Annexure 3 and 3A. It is also contended that though the petitioner is named in the first information report but the girl in her

No.31687 of 2016 (2) dt.02-09-2016 2 / 2 statement recorded under Section 164 Cr.P.C., though had identified the persons who had kidnapped her, but has not taken the name of the petitioner. It is contended that one of the coaccused, namely, Nand Lal Mahto has already been granted privilege of regular bail.

Having regard to the facts and circumstances of the case, let the petitioner, namely, Anant Kumar be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Mokama P.S. Case No. 182 of 2015, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Sri Deepak Kumar, Civil Court, Barh subject to the conditions as laid down under subsection(2) of Section 438 of the Code of Criminal Procedure.
