The appellant seeks regular bail in Chausa (Fulalut O.P.) P.S. Case No.120 of 2017 for the offence under Sections 341, 323,,307, 379, 427, 504, 506/34 of I.P.C. and Section 3(S) (X) of the SC/ST (Prevention of Atrocities)Act.

Allegation as per the F.I.R. against the appellant and several other co-accused persons is of assaulting the informant causing injury to him.

Submission of the learned counsel for the appellant is that there is nothing attributed against the appellant as in the whole F.I.R. and he has been falsely implicated in this case. He is in custody for more than one month.

Having heard both sides and in view of the facts and circumstances, as state above, the appeal is allowed. let the appellant, above named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of Special Judge, SC/ST Act, Madhepura, in H.A. Case No.271 of 2017 arising out of Chausa (FulautO.P.) P.S. Case No.120 of 2017 subject to the conditions that one of the bailors must be of a local person having sufficient immovable properties within the jurisdiction of the court concerned and he will cooperate in the trial and appear before the court on each and every date fixed in the case, failing which his bail bond will be cancelled.
