The petitioner is in custody since 11.05.2017 in connection with S.Tr. No. 64 of 2018 arising out of Pakaribarawan P.S. Case NO. 76 of 2017 for the offence registered under Sections 366(A), 504 and 506/34 of the Indian Penal Code. Learned counsel for the petitioner submits that though the application for bail was earlier considered and rejected twice, the victim girl in her statement during the course of the trial has categorically stated that she had herself gone away from her mother's place and the petitioner, Hare Ram Manjhi had nothing to do with her kidnapping. In her cross-examination, she has categorically stated that Hare Ram Manjhi had not kidnapped her

In view of statements made before the Court below by the Victim girl, the entire prosecution case appears to be under a cloud and as such, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Trial Court, i.e. 1st Additional Sessions Judge, Nawada in connection with S.Tr. No. 64 of 2018 arising out of Pakaribarawan P.S. Case NO. 76 of 2017.
