The petitioner apprehend his arrest in connection with Kinjar P.S. Case No. 43 of 2017 registered under Sections 392 of the Indian Penal Code, pending in the court of SubDivisional Judicial Magistrate, Arwal. The accusation is that informant was driving his truck on 18.04.2017 and at 11.45 P.M., when he reached at Mangrahat then four persons came out from Bolero vehicle, out of them, two forcibly entered in the cabin of truck and pulled the informant and his brother on the road. At that time, they also snatched his mobile phone.
Learned counsel for the petitioner submits that
Patna High Court Cr.Misc. No.53632 of 2018(4) dt.11-12-2018 2/2 petitioner is not named in the F.I.R. but in course of investigation, the name of the petitioner has surfaced in the confessional statement of co-accused.
The written report of informant clearly indicates that he has detailed the physique of the culprits, who indulged in the robbery. As such, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
