2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 126 (2), 115 (2), 118 (1), 117 (2), 109, 303 (2) and 3 (5) of the Bharitya Nyaya Sanhita pending in the Court of learned Judicial Magistrate-I, Motihari, East Champaran.

3. The allegation in the first information report is that one Sonu Kumar Singh had assaulted with farsa on the neck of the informant, however, it hit his head. There is further allegation that Jhunnu Kumar Singh (petitioner) assaulted the informant, Niranjan Singh causing injury on his chest, abdomen and right hand. He also assaulted Vikas Kumar Singh causing injury in his head.

4. Learned counsel for the petitioner submits that

It is also submitted that the present case is a counter blast of the case filed by co-accused, Tesar Singh against the informant and others. So far as the allegation on the petitioner is concerned, it is specific with regard to assault upon the informant, Niranjan Singh and Vikas Kumar Singh. The injury reports of Niranjan Singh and Vikas Kumar Singh have been annexed as Annexure2 and 2/1, which would show that out of total five injuries suffered by the informant at least three of the injuries are grievous in nature and out of three injuries suffered by Vikas Kumar, one injury is grievous in nature.

5. Learned APP for the State vehemently opposed the application for anticipatory bail.

6. Taking into consideration the facts and circumstances of the case and the nature of the injury, I am not inclined to grant the privilege of anticipatory bail to the petitioner. Accordingly, this application is rejected. (Soni Shrivastava, J) Trivedi/- U T
