The petitioners apprehend their arrest in Mushahari P.S. Case No. 165 of 2015 registered for the offences punishable under Sections 304(B) and 34 of the Indian Penal Code. The informant alleged that his sister Jasima Khatoon was married to Md. Nasim Ansari about six years ago but her husband and other in-laws were demanding dowry and on 02.10.2015 the accused persons killed his sister. It is submitted that the petitioners are mother-in-law and brother-in-law of the deceased. The petitioners have no manner of concern with the deceased and her husband. The deceased was living happily with her husband for last 61⁄2 years and she never
Patna High Court Cr.Misc. No.32075 of 2016 (3) dt.20-09-2016 2/2 made any complaint about ill-treatment against any in-laws. Similarly situated co-accused namely Noor Jehan @ Noor Jehan Khatoon, Shahjahan @ Shahjehan Khatoon and Rubee Khatoon have already enlarged on anticipatory bail vide order passed in Cr. Misc. No. 24659 of 2016 on 13.06.2016.
Considering the facts aforesaid and the fact that the petitioners are mother-in-law and brother-in-law of the deceased and no specific allegation is made against them, the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub-Judge III-cumAdditional Chief Judicial Magistrate, Muzaffarpur in Mushahari P.S. Case No. 165 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
