====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 12-07-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

This is the second attempt of the petitioner to seek bail as his prayer for bail was rejected by order dated 13.05.2022 in Cr. Misc. No. 72055 of 2021.

The petitioner is the husband of the deceased. Learned counsel for the petitioner submits that trial has commenced and three witnesses have been examined and four witnesses remained to be examined.

Since the trial has commenced and is progressing, as such, the Court is not inclined to grant bail to the petitioner in

Patna High Court CR. MISC. No.42915 of 2023(2) dt.12-07-2023 2/2 connection with Baunsi P.S. Case No. 97 of 2021 (S.T. No. 296 of 2022) pending in the Court of learned Sessions Judge, Araria/successor Court.

Accordingly, the prayer for bail is rejected. However, the learned trial court is directed to ensure that the trial of the case is expedited and is concluded preferably within a period of nine months from the date of receipt/production of a copy of this order.
