Petitioner apprehends his arrest in a complaint case filed under Sections 420/409 of the Indian Penal Code. Learned counsel for the petitioner on instruction submits that the petitioner is ready to deposit the amount disclosed in the first information report which is alleged to have been transferred by him to other accounts including one of the accounts in the name of his daughter.
Learned counsel for the State Bank of India submits
Patna High Court Cr.Misc. No.47683 of 2015 (4) dt.08-03-2016 2 / 3 that the amount has now swelled up-to Rs.18,00000/-, however, when he was directed to show the statement, he submitted that statement is only for Rs.13,47,527.24, however, it has verbal instruction.
Having regards to the facts and circumstances of the case, in the event of arrest/surrender within a period of eight weeks from today in Begusarai Town P.S. Case No.382/2015, the above named petitioner, Manoj Kumar Das shall be released on provisional bail for 3 months on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of C.J.M., Begusarai subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure with a further condition that at the time of furnishing bail bond, the petitioner would be required to deposit demand draft of Rs.7,00,000/- in the name of State Bank of India, Barauni Refinery Township Branch.
Thereafter, within three months, he will have to deposit the rest balance amount which has been described in the first information report. If the petitioner deposits the aforesaid amount as stated in the first information report within the aforesaid period and aforesaid manner, the provisional anticipatory bail granted to him would be made absolute by the court below.
