2. The petitioner is seeking regular bail in connection with Laxmipur P.S. Case No. 544 of 2023 for the offences punishable under Section 392 of the Indian Penal Code.

3. As per allegation, some unknown accused persons opened the dikki of motorcycle of the informant and took away cash, Samsung Tab, bio-metric machine and mobile phone etc.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that the name of the petitioner has been figured in this case only on the basis of suspicion. The petitioner is under custody since 14.12.2023.

5. On the other hand, the learned APP for the State has

Considering the above-mentioned facts and circumstances as also the fact that looted mobile set was recovered from possession of the petitioner and on his disclosure, the tablet was also recovered, I do not think it to be a fit case for grant of bail, which is hereby rejected.
