The petitioner apprehends his arrest in Atri P.S. case No.100 of 2013 under Section 420, 406, 467, 468, 471/34 of the Indian Penal Code.
The petitioner being Panchayat Rojgar Sevak along with other accused persons are alleged to have withdrew the amount of MANREGA and did not distribute the same among the beneficiaries.
The learned counsel for the petitioner submits that although petitioner got employment as Panchayat Rojgar Sevak but in the year 2012 itself the petitioner got employment in Indian Railway and the petitioner has no knowledge about the institution
Patna High Court Cr.Misc. No.28610 of 2016 (6) dt.15-12-2016 2/2 of the present case. Similarly situated other accused persons have already been granted bail vide orders passed in Cr. Misc. No. 12753 of 2015 and in Cr. Misc. No. 15530 of 2015. The case of petitioner stands on the same footing. It is further submitted that the beneficiaries have already received their amount. Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Gaya in Atri P.S. Case No. 100 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) BKS/- U T
