The petitioner seeks bail in a case registered under Sections 420, 376 of the Indian Penal Code.
Prosecution case in short is that the petitioner on the false pretext of marriage, established physical relationship with the informant but later on, he refused to perform marriage with the informant and that is why, present case has been lodged. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 21-04-2019. Charge sheet has already been submitted. On the false pretext of marriage, the petitioner is alleged to have established physical relationship
Patna High Court CR. MISC. No.39341 of 2019(2) dt.27-06-2019 2/2 with the informant. The allegation, made in the FIR is denied by the petitioner. Except for this, there is no other substantive evidence to suggest the implication of the petitioner in the present case.
Counsel for O.P. No. 2 vehemently opposed the prayer for bail. On behalf of the State and O.P. No. 2, it is submitted that the petitioner is named in the Complaint Case/F.I.R.. Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri A.S. Prasad, learned Judicial Magistrate-Ist Class, Jhanjharpur, Madhubani in connection with Madehpur P.S. Case No. 52 of 2019. (Sudhir Singh, J) A.K.V.//- U T
