Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 149, 188, 341, 269, 270, 283, 353 of the Indian Penal Code, Section 3 of the Epidemic Diseases Act, 1897 and Section 51(b) of the Disaster

The prosecution case as per F.I.R is that in the leadership of co-accused Rajnikant and petitioner Vikash Kumar, 400-500 people formed an unlawful assembly and raised anti-government slogan, blocked the road and thereby disobeyed the rule of COVID-19.

It is submitted by learned counsel for the petitioner petitioner has falsely been implicated in this case. There is no specific role against the petitioner in creating hindrance in discharging of the official duties. In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria(Chitragupta Nagar) P.S.
