Arvind Kumar and Rakesh Kumar Mehta while were indulged in lifting Asha Kumari and Nira Kumari from their house in dead of night, were apprehended by the villagers on hue and cry raised by their father as well as both the victims. Subsequently thereof, Panchayati was convened and during course thereof, this petitioner along with others armed variously came and attacked upon the villagers in order to rescue to aforesaid Arvind Kumar as well as Rakesh Kumar Mehta.
From the case diary, it is evident that none had claimed to have sustained assault at the end of the petitioner and others. Petitioner has got no criminal antecedent and is under
Patna High Court Cr.Misc. No.40243 of 2017 (03) dt.01-11-2017 custody since 16.05.2017.
Accordingly, petitioner, Rohit Kumar Mehta @ Rohit Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Birpur, Supaul in connection with Ratanpura P. S. Case No.26 of 2017.
