JUSTICE MADHURESH PRASAD ORAL ORDER 19-09-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner seeks bail in a case registered for the offence under sections 394/302 of the IPC and under section 27 of the Arms Act.
Counsel for the petitioner submits that the petitioner has been implicated in this case on the confession of co-accused Puskar Singh. Even, the motorcycle, in question, has been recovered on the basis of confession of aforesaid co-accused and not on the confession of the petitioner. Similarly situated coaccused Bampi Singh and Siktu Sigh have already been allowed bail by this Court vide orders dated 10.7.2017 & 25.7.2017, passed in Cr.Misc.Nos.24647/2017 and 19956/2017. Prior to the instant case, no case is pending against him and he is in custody since 17.7.2017.
In view of the aforesaid submissions, let the petitioner as mentioned above be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge III, Araria in Sessions
Patna High Court Cr.Misc. No.45173 of 2017 (2) dt.19-09-2017 2/2 Trial No. 186 of 2017, Bousi Police Station Case No. 133 of 2015 on the following conditions:- (a) one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
(b) The petitioner will not induce any witness or tamper with the evidence.
(c) The petitioner shall co-operate in the disposal of trial and make himself available as and when required by the court and in the event of failure on his part to the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
