The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 341, 323, 353, 379, 447, 504, 427 and 506 of the Indian Penal Code. As per prosecution case is that all the accused persons entered into the camp after breaking the door with the help of axe and started abusing and assaulting the informant and other forest guards with lathi and danda and they also uprooted solar plate from the camp and took away the same.

It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He

No.52250 of 2021(2) dt.06-04-2022 2/2 further submits that petitioners have not been apprehended at the spot and no incriminating article has been recovered from the conscious or constructive possession of the petitioners and there is general and omnibus allegation against them. Learned APP appearing for the State has opposed the prayer for anticipatory bail.

In the facts and circumstances of the case, let the petitioners, above named in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judaical Magistrate-II, Bagha, West Champaran in connection with Gobardhana P.S. Case No. 01 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Brajesh Kumar/- U T
