The petitioners apprehends their arrest in connection with Sakra P.S. Case No. 202 of 2024 registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2022.

Prosecution case in short is that there is recovery of 45.06 liters liquor was recovered from motorcycle. 4.
Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.44486 of 2024(2) dt.03-07-2024 2/3 petitioners are innocent and have committed no offence as alleged against them and have falsely been implicated in the present case. It is submitted that name of the petitioners have been disclosed by apprehended co-accused, namely, Ravi Kumar. It is next submissions that petitioners are not the owner of the vehicle in question. Petitioner No. 1 bears six criminal antecedents , out of which two case is lodged for the offences under Excise Act, while petitioner No.2 bears one criminal antecedent. Co-accused has been granted regular bail by this Court vide order dated 07-05-2024, passed in Cr. Misc. No. 34527 of 2024.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners.

Considering the rival submissions made by the learned counsel for the parties, let the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Sakra
Patna High Court CR. MISC. No.44486 of 2024(2) dt.03-07-2024 3/3 P.S. Case No. 202 of 2024, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
