JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 650 of 2017 registered for the offences punishable under Section 498A of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act. Allegation against the petitioner, who happens to be husband of the complainant opposite party No.2, is that after keeping her for one year the petitioner and others started abusing her with respect to demand of Rs.2 lac and a four wheeler and also threatened her. Further allegation is that petitioner has illicit relationship with his Bhabhi and others also. Submission of learned counsel for the petitioner is that he is still ready to keep her with dignity and care. On the

In view of above facts and circumstances, this application is disposed of with direction to petitioner to surrender in the court below on 27.9.2019, on that day opposite party No.2 shall also remain present in court and court below shall release the petitioner on provisional bail for a period of three months to its own satisfaction and in the meantime learned court below shall refer the matter to the District Mediation Centre in order to watch their conduct and marital relationship and once the court below is satisfied on receipt of report of Mediation Centre, the court below shall confirm the bail bonds of the petitioner, otherwise the court below is free to pass any other order(s) as it may deem fit and proper, including cancellation of bail bonds of the petitioner.
