JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-02-2021 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Khagaria(Gangaur) P.S. Case No. 652 of 2020, G.R. No. 2672 of 2020 registered for the offence under Section 498(A) of the Indian Penal Code.
The petitioner being brother-in-law (Bhaisur) of the informant is alleged to have instrumental in torture of the informant along with other in-laws for nonfulfillment of dowry demand. Learned counsel appearing on behalf of the petitioner would submits that accusation is omnibus and
Patna High Court CR. MISC. No.38865 of 2020(2) dt.10-02-2021 2/2 general against the petitioner. The petitioner resides separately from the husband of the informant and due to relationship of the petitioner with the husband of the informant, he has been implicated in this case. The petitioner is in custody since 06.09.2020. Considering the fact that petitioner is brotherin-law (Bhaisur) of the informant and the period of custody since 06.09.2020, this Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 50,000/- (Rupees fifty thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Gangaur) P.S. Case No. 652 of 2020, G.R. No. 2672 of 2020.
