JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-06-2019 This is an application for grant of anticipatory bail in connection with Hathidah P.S. Case No. 70 of 2018, disclosing offences under Sections 341, 342, 328, 307 of the Indian Penal Code.
Prosecution story as per complaint petition is that the petitioner and other accused persons called the son of the informant to compromise the case regarding the land dispute, upon which the informant said his share lied on the road which be parted out, on that, they pushed him on Palang and after caught him administered poison on his mouth and thereafter, he was admitted in the hospital and discharged on the next day, but no medical report on record.
Submission of the learned counsel for the petitioner is that there is no specific allegation has been attributed against the
Patna High Court CR. MISC. No.39510 of 2019(2) dt.27-06-2019 2/2 petitioner and F.I.R. itself shows that there is no medical report of the doctor is available on the record.
Further, similarly situated co-accused have been granted provisional bail by a Co-ordinate Bench of this Court, vide order dated 30.04.2019 in Criminal Misc. No. 28437 of 2019.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M.-IV, Barh, Patna, in connection with Hathidah P.S.
