The petitioner seeks bail in Bahadurpur P. S. Case No. 146 of 2018 instituted for the offence under Section(s) 380 and 411 of the Indian Penal Code.

In the written report report, it is alleged that three mobile phones as mentioned in the written report and an amount of Rs. 18,000/- have been stolen away from the house of the petitioner. It is further alleged that on the strength of CC TV footage, which was installed in front of the house of the informant, the informant has identified the petitioner who has committed theft in his house. Thereafter, petitioner was apprehended by the informant and handed over to the police. The production-cum Seizure list is available in the FIR which

Patna High Court Cr.Misc. No.53469 of 2018(3) dt.19-11-2018 2/2 shows that one Apple I- phone-6 and an amount of Rs. 1520/- have been recovered from possession of this petitioner. There is no mention in the written report about the description of the Iphone. It has further been submitted that no T.I.P. of the recovered articles have been done.

It is mentioned in para 3 of the bail petition that petitioner has no criminal antecedent. The petitioner is in custody since 20.6.2018.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM-II, Patna City, Patna, in connection with Bahadurpur P. S. Case No. 146 of 2018 , G.R. No. 2991 of 2018 subject to the condition that both the bailers shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/- U T
