JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-08-2018 Issue of age of superannuation of the University teacher was finally adjudicated by the Apex Court in the case of Jagdish Prasad Sharma Vs. State of Bihar & Ors. reported in (2013) 8 SCC 633.

In view of the judgment of the Apex Court in the case of Jagdish Prasad Sharma (Supra) the writ petition is disposed of with the direction to the respondent to grant all consequential benefits keeping in view the age of teacher like the petitioner shall be 65 years.

Patna High Court CWJC No.1940 of 2010(3) dt.10-08-2018 2/2 Accordingly, the writ petition is disposed of with a direction to the respondents to take final decision in this regard within a maximum period of four months from the date of receipt/ production of a copy of this order.
