2. Heard learned counsel for the petitioner and learned A.P.P. for the State.

3. The petitioner seeks regular bail in connection with Baikunthpur P.S. Case No. 163 of 2023 registered on 13.05.2023 lodged under Sections 341, 323, 324, 307, 325, 447, 427, 506, 34 of the Indian Penal Code.

4. As per the prosecution case, F.I.R. has been lodged against 9 named accused persons, against whom allegation is that they all reached at the house of the informant and attacked on his mother by lathi, spear and talwar, due to which she was seriously injured and admitted to a hospital.

5. Counsel for the petitioner submits that petitioner and informant both are residents of the same village and well known to each other. He submits that from same date and place of occurrence,

Patna High Court CR. MISC. No.42717 of 2023(2) dt.14-07-2023 2/2 case and counter case have been filed before the said Baikunthpur P.S. Case No. 163 of 2023, in which petitioner seeking bail and another case Baikunthpur P.S. Case No. 164 of 2023 has been filed by the petitioner's side against the informant.

6. Counsel further submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 14.05.2023 having clean antecedent.

7. Learned counsel for the State opposes the prayer for bail.

8. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Baikunthpur P.S. Case No. 163 of 2023, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

9. With this observation, the bail application stands allowed.
