JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-09-2017 The petitioner seeks regular bail in connection with Chandan (Anandpur O.P.) P.S. Case No. 43 of 2015, registered for offences punishable under Sections 147, 324, 325, 307, 304, 504 and 506 of the Indian Penal Code and Section 3, 4 and 5 of Explosive Substance Act.
Allegation against the petitioner is of throwing bomb on the informant and another causing injuries to them. It has been submitted on behalf of the petitioner that petitioner has falsely been implicated in this case as there was previous enmity between the parties and further there is delay in lodging of F.I.R. It has also been submitted that petitioner has been in judicial custody for last ten months. Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.41820 of 2017 (2) dt.11-09-2017 Having heard both sides, considering the facts and circumstances of the case and also that petitioner has criminal antecedent as he is an accused in seven other cases, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, dismissed.
However, since the petitioner has been in custody for last ten months, trial court is directed to expedite the trial and try to conclude it within a period of nine months.
