05-10-2016 On call, none appeared on behalf of petitioner either to press the petition or to make a prayer for adjournment. On last date, the case was adjourned on the prayer made by learned counsel for the petitioner. Sri Ajay Kumar Sinha, learned counsel for the opposite party/Bank of India submits that show cause has already been prepared and due to non-availability of learned counsel for the petitioner, it could not be served. Sri Sinha intends to file show cause. He may file it in Registry. It is made clear that the Registry will accept the show cause of Sri Sinha in this case,
Patna High Court MJC No.2958 of 2015 (3) dt.05-10-2016 2/2 even in absence of service report of same on the petitioner. Sri Sinha submits that in compliance with the order of the writ court, the Bank has already vacated the premises of the petitioner and paid all the arrear rent.
The petition stands disposed of.
