ANJANA MISHRA ORAL ORDER 01-09-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in Complaint Case No. 3770 of 2013 registered for the offence punishable under Section 498A of the Indian Penal Code and 3 of the Dowry Prohibition Act Learned counsel for the petitioner submits that petitioner is a duty bound soldier and due to constraint of leave, he could not surrender within the stipulated period. As such, the anticipatory bail granted in his favour was cancelled and when he applied for extension of time, the same was refused by the court

Patna High Court Cr.Misc. No.31315 of 2016 (4) dt.01-09-2016 2/2 below which has necessitated him to file the present anticipatory bail application Considering the facts and circumstances of the case and that the petitioner was prevented by sufficient cause from surrendering in the court below, let the petitioner above named, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Chapra, Saran in Complaint Case No. 3770 of 2013, Tr. No. 2582 of 2015 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

It is made clear that if the petitioner does not surrender within the period of four weeks, the present order passed in his favour shall automatically stand cancelled. (Anjana Mishra, J.) ravi/- U T
