JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-10-2019 This is an application for grant of anticipatory bail in connection with Jamo Bazar P. S. Case No. 35 of 2019, disclosing offences under Sections 302, 328, 34 of IPC. As per F.I.R. the dead body of the deceased was dragged in a Maruti Van by the petitioner and other accused persons in front of the house of informant.
Submission of the learned counsel for the petitioner is that as a matter of fact, the deceased was residing in the house of the informant, i.e. in his Sasural and he has consumed poison there and in order to implicate the petitioner in a false and concocted case has been lodged, which has come during the course of investigation also and independent witness has stated so.
Heard learned A.P.P. also, who has submitted that one witness has stated so in his statement, though the other
Patna High Court CR. MISC. No.39589 of 2019(5) dt.01-10-2019 2/2 witnesses have supported the prosecution case. The Maruti Car in which the dead body was brought, has not been seized by the police.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M.-XII, Siwan, in connection with Jamo Bazar P. S. Case No. 35 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
