2. The petitioner is apprehending his arrest in connection with Rajoun P.S. Case No. 579 of 2022 dated 01.12.2022 registered for the offences punishable under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code.
3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have got the informant's land mutated on the basis of forged and fabricated sale deed.
4. Learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.52372 of 2024(7) dt.19-09-2025 2/3 that the petitioner is innocent and has been falsely implicated in this case. It is civil dispute between the informant and the accused persons. The petitioner has no concern with the alleged offence. It is further submitted that there is no specific allegation against the petitioner. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. Similarly situated co-accused has already been granted anticipatory bail by this court vide order dated 27.09.2023 passed in Cr. Misc. No. 59778 of 2023.
5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioner. 6.
Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/ surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail bond of Rs. 20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Banka in connection with Rajoun P.S. Case No. 579 of 2022, subject to the condition as laid down under Section 482(2) of the BNSS, with further condition/s:-
Patna High Court CR. MISC. No.52372 of 2024(7) dt.19-09-2025 3/3 (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
7. The application stands allowed.
