Petitioner is apprehending his arrest in connection with a case for the offence under Section 376/511 of the Penal Code registered on the basis of a complaint case which is said to have been lodged after two days of the occurrence. It is submitted on behalf of the petitioner that no explanation for delay of two days and allegation of previous enmity is indicated in the complaint. Aforesaid point be better considered and appropriate order passed in the matter if the petitioner, named above, surrenders in the court below (Chief Judicial Magistrate, Samastipur)
Patna High Court Cr.Misc. No.48205 of 2015 (2) dt.03-11-2015 within four weeks from the date of receipt/production of a copy of this order in the court below and applies for regular bail in connection with Khanpur P.S. Case No. 48 of 2015.
