Meena Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 12-07-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 341, 323, 307, 379, 504 and 506/34 of the Indian Penal Code.
Allegation against the petitioner is that while the informant was assaulting by the accused persons, petitioner took away Rs.7000/- and a mobile phone from his pocket. It is submitted on behalf of the petitioner that he has got no criminal antecedent. It is a case and counter case between the parties. Specific allegation of assault is alleged against co-accused Md. Zakir. As far as offence under Section 379 of the Indian Penal Code is concerned, same is ornamental. No specific injury has been attributed against the petitioner.
On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his/her arrest or surrender in the court below within a period of six weeks, be released on bail
Patna High Court Cr.Misc. No.27321 of 2016 (2) dt.12-07-2016 2/2 on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga, in connection with Laheria Sarai P.S.
