The petitioners apprehend their arrest in connection with Haspura P.S. Case no. 161 of 2018, registered under Section 379/34 of the Indian Penal Code. The accusation is that the standing Jamun tree of the informant fell down, thereafter, the same was took away by six persons named in the F.I.R., including the petitioners as a result whereof, the informant lost Rs. 20 thousand. Learned counsel for the petitioners submits that, in fact, the alleged Jamun tree is situated in the filed of

Patna High Court Cr.Misc. No.54878 of 2018(3) dt.11-12-2018 2/2 petitioners and in the storm, some branches of the said tree fell down, but with ulterior motive due to land dispute, the informant lodged the present case. Further submission is that petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M. Daudnagar, Aurangabad in connection with Haspura P.S. Case No. 161 of 2018, subject to the condition as laid down under Section 438

(2) of the Cr.P.C.
