The petitioners are apprehending their arrest in connection with Kako P.S.Case No.7/2017 dated 5.1.2017 , registered for offences punishable under Sections 341, 323, 307, 379, 504 and 34 of the Indian Penal Code. FIR discloses the allegation that while the informant was installing harvesting machine, the petitioners tried to took away the machine and when he raised hulla one co-accused Arun Kumar assaulted the informant and the petitioner also assaulted him .
Submission of the learned counsel for the petitioners is that there is case and counter case between the parties and
Patna High Court CR. MISC. No.42358 of 2019(2) dt.09-07-2019 2/2 moreover the police after investigation has submitted final form against the petitioners and the cognizance has been taken. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, surrender before the court below within a period of six weeks from the date of receipt of order and on surrender they will be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Jehanabad in connection with Kako P.S.Case No.7 of 2017 dated 5.1.2017, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
With the aforesaid direction, this application is allowed.
