The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 341, 337, 332, 353, 307, 302 of the Indian Penal Code and 27 of the Arms Act.
It is alleged that one Parmeshwar Seth was convicted for the theft of electric energy and then the police restrained him from doing so, when the mob blocked the road and pelted stones. It is alleged that one Kishore Kumar, Sub Inspector of Police was assaulted by the mob who subsequently succumbed to injuries. It is submitted by the learned counsel for the petitioner that accusation is against the mob. The arrest of
Patna High Court Cr.Misc. No.15473 of 2013 (4) dt.18-03-2015 petitioner was stayed which gets reflected from paragraph-157 of the case diary which is not controverted by the learned A.P.P. after going through the case diary and investigation is still pending against the petitioner. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent and vide Cr. Misc. No. 46738 of 2012 similarly situated co-accused Birendra Mishra and Adalat Ansari have been granted anticipatory bail.
Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Kochas (Parsathua) P.S. Case No. 154 of 2002, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
