The petitioner is a licensee under the Public Distribution System (Control) Order, 2001 bearing Licence no.324 of 2007. The licence of the petitioner was cancelled on grounds of alleged irregularities by the Licensing Authority cum Sub-Divisional Officer, Dumraon, District- Buxar vide order dated 19.7.2013, a copy of which is placed at Annexure-3 to the writ petition. The petitioner being aggrieved has preferred a statutory appeal before the District Magistrate, Buxar bearing Misc. Appeal No.93 of 2013 but in view of the delay in disposal of the appeal by the appellate authority that the present writ petition was filed.

Patna High Court CWJC No.464 of 2014 (2) dt.31-03-2015 Having heard learned counsel for the parties and taking note of the circumstances existing, this writ petition is disposed of with a direction to the District Magistrate, Buxar to consider and dispose of the Misc. Appeal No.93 of 2013 in accordance with law and after giving opportunity of hearing to the petitioner expeditiously and preferably within a period of three months from the date of receipt/production of a copy of this order.
