JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 08-12-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Siwan (Town) P.S. Case No.290 of 2015 registered under Sections 419, 420, 465, 468, 471, 504 and 506 of the Indian Penal Code. Learned senior counsel for the petitioner submits that initially a complaint was filed which was referred to the police under section 156(3) of the Code of Criminal Procedure pursuant to which an FIR was registered. The allegation made in the FIR is false, fabricated and concocted.

On the other hand, learned counsel for the complainant

Patna High Court Cr.Misc. No.53576 of 2015 (2) dt.08-12-2015 2/2 has submitted that the petitioner is named accused and he in conspiracy with co-accused persons cheated the complainant. Be that as it may, taking into consideration the nature of the allegation, in event of arrest or surrender in the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Siwan Town P.S. Case No.290 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
