The petitioner seeks regular bail in Bihta P.S. Case No.233 of 2017 registered for the offence under Sections 25(1B)(a), 26 and 35 of the Arms Act. Allegation against the petitioner is of recovery of country made Katta from his possession. Submission of the learned counsel for the petitioner is that though he has been made accused in six other cases but in those cases he has not been named, later on his name transpired in course of investigation on the basis of confessional statement of co accused. He is on

Patna High Court Cr.Misc. No.41497 of 2017 (2) dt.07-09-2017 2/2 bail in all those cases except one more case. He is in custody since 13.04.2017.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with direction to the court below that once trial is commenced against the petitioner within six months or the petitioner completes seven months in custody, he shall be released on bail to his own satisfaction.

With the aforesaid observation, this application is disposed of.
