2. Petitioner seeks regular bail in connection with NH Bangra P. S. Case No. 151 of 2024 in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022
3. As per the prosecution case, 34.500 liters of illicit foreign liquor were recovered from a sack kept on the motorcycle, and this petitioner is the registered owner of said motorcycle.
4. Learned counsel for the petitioner submits no incriminating material has been recovered from conscious possession of the petitioner and he is no way connected with the
Patna High Court CR. MISC. No.42296 of 2025(2) dt.08-08-2025 2/2 aforesaid recovery. Further, it has been submitted that though petitioner is the owner of the motorcycle in question, on the day of occurrence, the same was given to a co-villager Manoj Kumar for purchasing medicine. Petitioner is in custody since 29.04.2025. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise-I, Samastipur in connection with NH Bangara P. S. Case No. 151 of 2024.
