The petitioner prays for bail in connection with Sahebganj P.S.Case No. 287 of 2017 registered for the offences punishable under Sections 392/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation as per FIR is of snatching of motorcycle and also of assault by butt portion of pistol and petitioner is not named in the FIR.

Submission of learned counsel for the petitioner is that he was later on made accused in this case on the basis of confessional statement of co-accused and he was not put on T.I.P. and there is no recovery from his possession and he is in custody since 1.6.2018.

Having heard both sides and in the facts and circumstances, as stated above, this application is disposed of with a direction to the learned court below that once petitioner completes six months period in custody, he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, (West) Muzaffarpur, in connection with Sahebganj P.S.Case No. 287 of 2017, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
