29-01-2016 Heard Sri Ashok Kumar, learned counsel for petitioners and learned Addl. Public Prosecutor. Four petitioners, apprehending their arrest in Chapra Town P.S. Case No. 170 of 2015 registered for the offence under Sections 341, 323, 307, 504, 34 of the Indian Penal Code, have prayed for grant of anticipatory bail.
It was submitted by learned counsel for petitioners that on a trivial dispute, occurrence had taken place in between the petitioner no. 1 and his own brother & his family members and falsely, petitioner no. 2, who is wife of petitioner no. 1 and his two daughters (petitioner nos. 3 & 4) have been implicated, as accused in the present case.
Patna High Court Cr.Misc. No.47704 of 2015 (3) dt.29-01-2016 2/2 I have perused the F.I.R. and materials available on record. So far as prayer for bail of petitioner no. 1 is concerned, the Court is not inclined to extend the privilege of anticipatory bail. Accordingly, the prayer for anticipatory bail in respect of petitioner no. 1 stands refused.
So far as petitioner no. 2, 3 & 4 are concerned, keeping in view the fact that they are female and nature of accusation, let petitioner no. 2 (i.e. Sunita Devi), petitioner no. 3 (i.e. Kajal Kumari @ Juli Kumari) and petitioner no. 4 (i.e. Priya Kumari @ Gita Kumari) be enlarged on bail, in the event of their arrest or surrender within a period of six weeks from today, on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra/concerned court in connection with Chapra Town P.S. Case No. 170 of 2015 subject to condition, as contemplated under Section 438 (2) of the Cr.P.C. (Rakesh Kumar, J.) Anay U T
