JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-07-2019 This application, for grant of anticipatory bail, arises out of Brahmpura P.S. Case No. 37 of 2015, disclosing offences under Sections 406, 419, 420, 467, 468, 471, 120B of the Indian Penal Code.

Allegation is that the police received secret information that some miscreant are standing the ATM of SBI at Laxmi Chowk, Muzaffarpur, on which, police went there and arrested two persons and recovered ATM cards and on being asked they could not reply satisfactorily with regard to the said ATMs and further they disclosed the name of petitioner as their associate.

No.41043 of 2019(2) dt.03-07-2019 2/2 except the confession of co-accused, there is nothing against the petitioner and the co-accused having similar allegation has been granted the privilege of anticipatory bail by coordinate Bench of this Court vide order dated 17.12.2018 passed in Cr. Misc. No. 68450 of 2018.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Muzaffarpur, in connection with Brahmpura P.S. Case No. 37 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
