2. The petitioner is seeking regular bail in connection with Deepnagar P.S. Case No. 12 of 2024 corresponding POCSO Case No. 08 of 2024 for the offences punishable under Sections 376, 354(B), 323, 506 and 509 of the IPC and Sections 3(A), 3(B), 4 and 6 of the POCSO Act.

3. The petitioner used to come to the house of the informant and in that course he tried to develop love and affection with the complainant and consequently, forcibly closing the mouth the petitioner is allegedly established physical relation with the couple.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.46185 of 2024(2) dt.04-07-2024 2/2 that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that the petitioner is not residing in his village. The petitioner has no criminal antecedent and is under custody since 20.05.2024.

5. On the other hand, the learned APP for the State has opposed the prayer for bail and submitted that in her statement recorded under Section 164 of the CrPC, the victim has supported the prosecution.

6. Considering the above-mentioned facts and circumstances as well as the gravity of the allegation, I do not think it to be a fit case for bail, which is hereby rejected. (Nawneet Kumar Pandey, J) Nirmal/- U T
