For the Petitioner/s : Mr. Ram Narayan Brahmachari, Advocate For the Opposite Party/s : Mr. Sri Ram Sumiran Roy (APP) ====================================================== CORAM: HONOURABLE MR. JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 06-09-2017 Heard learned counsel for the petitioner and the learned counsel representing the State.
The petitioner wants to renew the prayer of bail which was earlier twice rejected by order dated 22.04.2016 and 22.03.2017 passed in Cri. Misc. No. 51100 of 2015 and Cr. Misc. No. 12193 of 2017, on the ground that the petitioner is suffering in custody since 06.02.2015 and the trial has not been concluded within time given by this Court and, as such, the petitioner deserves sympathetic consideration.
The learned A.P.P. opposes the prayer of bail by submitting that the trial is in progress.
In the facts and circumstances stated above, finding no good ground for reconsideration of prayer of the bail, again
Patna High Court Cr.Misc. No.41980 of 2017 (2) dt.06-09-2017 2/2 prayer of the bail of the petitioner stands rejected. However, the learned trial court is directed to conclude the same as early as possible preferably within three months from the date of receipt/production of a copy of this order, failing which, if the petitioner is at no fault he may be at liberty to renew his prayer for bail.
